Monster Energy® x Call of Duty®: Modern Warfare® III DLC Promotion

1. ELIGIBILITY

   1. This Promotion is open to all Malaysian citizens, residents, work permit holders, valid Malaysia pass holders and valid in Malaysia only.
   2. Persons ineligible and excluded from this Promotion are: (a) Employees of Promoter and their advertising, fulfilment and promotion agencies; (b) Affiliates and subsidiaries and the immediate families (spouses, and parents, siblings, children and each of their spouses and household members) of each of (a).

2. PROMOTION PERIOD

   1. The Promotion starts at 00:00 hours on 1st November 2023 and ends at 23:59 hours on 31st January 2024 (“Promotion Period”).
   2. Any entry not received during the Promotion Period shall be automatically disqualified from participation. The Promoter is not liable for any lost, delayed or misdirected entries.
3. HOW TO PARTICIPATE
   1. Participants are required to scan the promotion QR CODE as printed on The Promotion in-store Point of Sale materials or log on to https://www.monstercontest.com.my.
   2. Participants are required to follow instructions on the promotion page. The instructions require the participants to upload a photo of the Proof of Purchase for verification purposes, Participant's full name and email address.

   3. How to Obtain DLC Codes:

      • To obtain codes redeemable for DLC in Call of Duty: Modern Warfare III video game, Participants must purchase any participating Monster Energy® products ("Qualifying Purchase") from any retailer in the Promotional Territory during the period of 1st November 2023 to 31st January 2024 (the "Qualifying Purchase Period") and take a picture of their purchase receipt; list of participating products is attached as Exhibit "A" and such products are collectively referred to hereinafter as, ("Qualifying Products"). Qualifying purchases are based upon the number of individual cans/bottles of Qualifying Product made in the purchase (e.g., a purchase of one (1) 4-Pack of Monster Energy® equals four (4) cans). Each can/bottle purchased (up to one hundred sixty (160)) earns Participants fifteen (15) minutes of 2XP for use in the game and progress towards three (3) pieces of in-game content for one (1) platform in Call of Duty: Modern Warfare III (the "Game") Limit of one (1) hour of 2XP tokens per day, forty (40) hours total. Applies to all 2XP redemptions for Call of Duty: Modern Warfare III, not limited to this Promotion. Once Participants have accumulated enough cans/bottles from valid purchases (on one or multiple receipts), Participants can redeem cans/bottles for unique promotion codes (each individually a "DLC Code"; collectively, "DLC Codes") in the increments and for the items set forth below. Upon reaching each tier as set out in the table below, Participants will receive a DLC Code for that particular tier. Participants will have until 31st January 2024, to redeem their purchased cans/bottles for DLC Codes and redeem their DLC Codes; after such date, receipt uploads of Qualifying Purchases cannot be redeemed, and the Website will be taken down. Participants can redeem a maximum of 160 cans/bottles. Exceeding this limit will disqualify Participants from receiving further DLC Codes. While supplies last.

        If any part of a DLC Code is counterfeited or improperly reproduced, or if the DLC Code comes from other games or promotions (whether operated by Monster or any third-party), or if any part is illegible, mutilated, or tampered with in any way, or if it contains or reflects printing, typographical, mechanical or other errors, the DLC Code will be rejected and will be deemed void and invalid.

        1. Each Entry shall be subject to verification by the Promoter and / or its representatives. If details are invalid as determined by the Promoter’s sole discretion, the entry will be disqualified.
           • Personal information (including images) collected or received from the Participants may be used by the Promoter, Innity Sdn Bhd, and/or their respective agents and agencies for the purposes of administering the Promotion, including conducting background checks on the Participant’s identity and verifying their eligibility to participate and receive a prize. By participating in the Promotion, the Participant explicitly allows the Promoter, Innity Sdn Bhd, and/or their respective agents and agencies to contact the Participant via the Participant’s particulars provided for such purpose. The Promoter, Innity Sdn Bhd, and their respective agencies value all personal information received and shall not disclose or furnish the Participant’s personal information to any unrelated third parties (save for their respective agents and agencies for the purposes of this Promotion or where required by law). The Promoter shall manage all personal information collected, which contains personal data, according to the Personal Data Protection Act 2010.
           • Any Entry that is illegible, mutilated, altered, duplicated, tampered with, not obtained legitimately, contains printing typographical, mechanical or other errors or the printing is unclear or does not contain information or proof purchase required in the Participant Form is invalid.
           • All Entries (including the Proofs of Purchase) submitted become the property of the Promoter and will not be returned.

4. VERIFICATION

   1. Entries submitted are subject to verification.
   2. The Promoter’s decision on all matters relating to the Promotion is final, conclusive and binding. No correspondence will be entertained.

5. OTHER CONDITIONS

   1. All promotional materials, as detailed on the How to Participate form, are part of these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions with any advertising, promotional or publicity materials in relation to or in connection with the Promotion, these Terms and Conditions shall prevail.
   2. The Promoter, Innity Sdn Bhd, are not and shall not be held responsible for any delay, error or any other problems in the operation of the Promotion caused by or arising from breakdown, technical malfunction of any telephone network or lines, computer or online systems, servers or providers, computer equipment, software, failure of email on account of technical problems and/or traffic congestion on the internet and/or at any website or the telecommunication service or a combination thereof, including injury or damage to any participants or to any other person’s computer or mobile phone related to and/or resulting from participating or downloading materials in or in connection with the Promotion.
   3. In no event will the Promoter, Innity Sdn Bhd, and/or their respective parents, affiliates, subsidiaries and related companies, their respective advertising or promotion agencies or their respective officers, directors, employees, members, shareholders, attorneys, respective agents (collectively, “Affiliates”), be responsible or liable for any damages or losses of any kind, including but not limited to direct, indirect, incidental, consequential, special or punitive damages arising out of any the Participant’s acceptance of the Prizes (if selected as winner), or their entry into the Promotion. By entering into the Promotion, participants hereby release and agree to hold harmless the Promoter, Innity Sdn Bhd, and/or their Affiliates from and against any and all rights, demands, claims, cause of action, losses, damages, costs and expenses whatsoever that they may have, or which may arise, whether in whole or in part, and whether directly or indirectly.
   4. The Promoter, Innity Sdn Bhd, and/or their Affiliates make no warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose of any of the Prizes. Without limiting the generality of the foregoing or anything in these Terms and Conditions, the Promoter, Innity Sdn Bhd, and/or their Affiliates are not liable for any defect in the Prizes. To avoid doubt, no provision in these Terms and Conditions shall be construed as limiting the liability of any party for death or personal injury caused by such party’s negligence or any liability which cannot be excluded under the laws of Malaysia.
   5. By participating in the Promotion, the Participant explicitly allows the Promoter, Innity Sdn Bhd, and/or their respective agents and agencies to contact the Participant via the particulars provided for such purpose. The Promoter, Innity Sdn Bhd, values all personal information received and shall not disclose or furnish the Participant’s personal information to any unrelated third parties (save for their respective agents and agencies for the Promotion or where required by law).
   6. Notwithstanding any of the foregoing, the Promoter reserves the right to amend, add, replace, vary and/or modify these Terms and Conditions without prior notice. Entry into this Promotion confirms acceptance of these Terms and Conditions and any amendments, additions, replacements, variations and modifications hereto, which shall be final and binding in all respects.
   7. This Promotion and the Terms and Conditions shall be governed by the laws of Malaysia. The parties hereby submit to the exclusive jurisdictions of the courts in Malaysia.
   8. The Promoter is Innity Sdn Bhd, whose principal place of business is at C501 & C502, Block C, Kelana Square, 17, Jalan SS7/26, 47301 Petaling Jaya, Selangor Darul Ehsan.
   9.
